Acceptance of Terms

By accessing or using the Calc1Cut mobile application and website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that you are at least 18 years of age.

License Grant

Subject to your compliance with these Terms, Kolmira UG grants you a limited, non-exclusive, non-transferable, revocable license to:

  • Download, install, and use the Calc1Cut mobile application on a device you own or control
  • Access and use the Service for personal or commercial purposes in the construction trades

One-Time Purchase: Your purchase grants you a lifetime license to use the version you purchased. Major version updates may require an additional purchase. Minor updates and bug fixes are included in your license.

Restrictions on Use

You may NOT:

  • Reverse engineer, decompile, or disassemble the Service
  • Copy, redistribute, or resell the Service
  • Remove, alter, or obscure any copyright, trademark, or other proprietary rights notices
  • Use the Service for any unlawful purpose
  • Transfer your license to another person without written consent from Kolmira UG

⚠️ CALCULATOR ACCURACY & LIABILITY DISCLAIMER

THIS IS A CRITICAL SECTION. PLEASE READ CAREFULLY:

Calc1Cut is provided "AS-IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. While we strive for accuracy in all calculations:

  • YOU ARE SOLELY RESPONSIBLE for verifying all measurements, calculations, and results before using them in construction work.
  • YOU ARE SOLELY RESPONSIBLE for ensuring compliance with all applicable local, state, and national building codes. The app provides guidance based on IRC 2021 (United States) and DIN 18065 (Germany), but local codes may differ and take precedence.
  • WE ARE NOT LIABLE for construction errors, material waste, failed building inspections, structural failures, property damage, injuries, or any other damages arising from your use of the Service.
  • ALWAYS CONSULT licensed professionals (architects, structural engineers, building inspectors) for structural and safety-critical work. This app is a calculation tool, not professional engineering or architectural advice.
  • NO WARRANTY OF ACCURACY: We make no warranty that the Service is error-free, accurate, or suitable for any particular construction project.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KOLMIRA UG DISCLAIMS ALL WARRANTIES AND SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

Building Code Compliance

The Service provides calculations and compliance checks based on:

  • IRC 2021 (International Residential Code, United States)
  • DIN 18065 (German standard for staircases)

Important: Local building codes, municipal regulations, and state requirements may differ from these standards. Always verify compliance with your local jurisdiction before beginning construction. The final authority is your local building inspector and applicable codes.

Intellectual Property

The Service, including all software, algorithms, user interface designs, graphics, logos, and content, is owned by Kolmira UG and protected by copyright, trademark, and other intellectual property laws. "Calc1Cut" and the Calc1Cut logo are trademarks of Kolmira UG. You may not use these trademarks without prior written consent.

Payment Terms

Calc1Cut is offered as a one-time purchase through the Apple App Store. Payment terms include:

  • One-Time Payment: No subscriptions or recurring fees
  • Early Bird Pricing: Discounted pricing may be available during beta and early access periods
  • No Refunds: All sales are final. Refund requests are subject to Apple App Store policies

Beta Testing & TestFlight

Calc1Cut is currently in beta testing via Apple TestFlight. By participating in beta testing:

  • You acknowledge the app may contain bugs, errors, or incomplete features
  • You agree to provide feedback and report issues you encounter
  • You understand that features may change before the final release
  • TestFlight access may be revoked at any time

Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Behavior that harms or could harm other users or the Service

Upon termination, your license to use the Service will immediately cease, and you must delete all copies of the app from your devices.

Updates & Modifications to Service

We may update, modify, or discontinue any aspect of the Service at any time. Version updates are handled as follows:

  • Minor Updates (e.g., v1.1, v1.2): Included free with your license (bug fixes, performance improvements, minor features)
  • Major Updates (e.g., v2.0, v3.0): May require an additional purchase (significant new features, redesign)

Governing Law & Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved exclusively in the courts of Stuttgart, Germany (place of registration).

Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
